MOBILE SAUNA AND COLD PLUNGE UNIT — TERMS OF USE
These Terms of Use ("Agreement") apply to all individuals ("Users") who access, use, or hire the mobile sauna, cold plunge, drench bucket, and associated equipment ("Unit") provided by BitterSweat (Nomadic Sauna & Ice Pty Ltd ABN 76 680 023 009) ("Owner"). By using the Unit, all Users agree to the following terms and conditions.
1. User Responsibilities
1.1. Users acknowledge that they use the Unit at their own risk and must assess their own suitability for participation.
1.2. Users must follow all safety instructions and guidelines provided by the Owner or its representatives for proper operation of the Unit.
1.3. Users with health conditions that may contraindicate the use of saunas, cold plunges, or drench buckets — including but not limited to cardiovascular conditions, high or low blood pressure, respiratory issues, diabetes, epilepsy, recent surgery, pregnancy, or any other relevant medical condition — must not use the Unit. Users on prescription medication (including but not limited to blood pressure medication, diuretics, sedatives, and stimulants) should seek medical advice before use. It is the User's responsibility to seek medical advice if unsure.
1.4. Users must not use the Unit while under the influence of alcohol, recreational drugs, or any substance that may impair judgement or physical capacity. Alcohol must not be consumed prior to, during, or between rounds of any session.
1.5. Users must ensure the provided steps, including the handrail, are used at all times when getting on and off the trailer.
1.6. The Unit must not be used on public or council land unless appropriate permits or permissions are in place.
1.7. The sauna must not be used on days of a declared Total Fire Ban, in accordance with local fire safety regulations and CFA guidelines.
1.8. Users must respect the Unit and its surroundings, keeping the area clean and free from damage.
1.9. Any User who hires the Unit for an extended period without the on-site supervision of a BitterSweat representative is responsible for ensuring that all participants under their booking comply with this Agreement, and assumes full responsibility for safe and lawful operation of the Unit during the hire period.
1.10. Children under 18 years of age must not use the Unit unless explicitly authorised in writing by the Owner and accompanied by a parent or legal guardian who has accepted this Agreement on their behalf.
2. Assumption of Risk and Liability
2.1. Users acknowledge that the use of a wood-fired sauna, cold plunge, and drench bucket carries inherent risks including, but not limited to: fire hazards, burns, scalds, smoke inhalation, heat stress, dehydration, fainting, cold shock, cardiac stress, slips, trips, falls, and injuries from wet or uneven surfaces.
2.2. Users assume full responsibility for their safety and actions while using the Unit, and for monitoring their own physical condition throughout each session.
2.3. To the fullest extent permitted by law, the Owner is not responsible for any injuries, damages, illness, or losses resulting from the use or misuse of the Unit, including injuries caused by other Users in shared or group sessions.
2.4. Users agree to indemnify and hold harmless the Owner, its directors, employees, contractors, and affiliates from all claims, damages, losses, costs, and expenses (including legal costs on a full indemnity basis) arising out of or in connection with the use or misuse of the Unit.
2.5. Nothing in this Agreement excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law that cannot lawfully be excluded.
3. Prohibited Uses
3.1. The Unit may not be used for any purpose other than wellness, recovery, and related activities expressly approved by the Owner.
3.2. Users must not modify, alter, repair, or tamper with the Unit, its fixtures, fittings, or fuel sources in any way.
3.3. Users must not sublet, transfer, or allow unauthorised third parties to use the Unit without prior written consent from the Owner.
3.4. The Unit must not be used in any manner that breaches local laws, council regulations, fire restrictions, or licensing conditions of the venue where the Unit is located.
4. Owner Responsibilities
4.1. The Owner will provide the Unit in clean, safe, and operational working condition at the commencement of each session or hire period.
4.2. The Owner will supply reasonable instructions, guidance, and support for the safe operation of the Unit.
4.3. The Owner is not responsible for the suitability of any third-party venue or location at which the Unit is deployed beyond its own assessment of safe operating conditions.
5. Personal Property
5.1. The Owner accepts no responsibility for loss, theft, or damage to personal property brought to or near the Unit. Valuables, electronics, jewellery, and watches should not be taken into the sauna or plunge facilities.
6. Photography and Media
6.1. The Owner may capture photographic or video content during sessions for promotional purposes. Users who do not wish to appear in such content must notify the Owner or its representatives in advance, and reasonable steps will be taken to respect that request.
7. Termination of Use
7.1. The Owner reserves the right to refuse, suspend, or terminate access to the Unit for any User who fails to comply with these Terms of Use, who appears intoxicated, or whose conduct poses a risk to the safety of themselves or others.
7.2. Where access is terminated for breach of this Agreement, no refund or credit will be issued.
7.3. Users in breach of this Agreement may be liable for damages and subject to legal action.
8. Governing Law
This Agreement is governed by and construed in accordance with the laws of the State of Victoria, Australia. Any dispute arising under or in connection with this Agreement is subject to the exclusive jurisdiction of the courts of Victoria.
9. Acknowledgment and Agreement
By using the Unit, the User acknowledges that they have read, understood, and agreed to these Terms of Use. This Agreement operates in conjunction with any session-specific booking terms or waivers issued by the Owner at the time of booking.
